South Toe Man Arrested in Estatoe Acres Shooting

Rodney Adam Forbes, of Wintergreen Patch Road, Burnsville, N.C., was arrested for allegedly shooting another man in the back at Estatoe Acres in the Estatoe community..

ESTATOE, N.C. – A South Toe man was arrested and jailed after he allegedly shot another man in the back.

On Friday, August 11, 2017, Mitchell County Communications received 911 call from a person reporting a complaint of a gunshot discharge at Estatoe Acres in the Estatoe community of Spruce Pine. The complainant also advised dispatchers that a person had been shot in the back on Sean Drive. Deputies with the Mitchell County Sheriff’s Office was dispatched to the scene to investigate the complaint.

Deputies with the Mitchell County Sheriff’s Office responded to the scene of the complaint and began searching the area for the suspect believed to be involved in the shooting. During their search, officers observed a male subject come out of the woods near the scene and he was immediately detained. During officer questioning, the suspect denied ever having a gun. After a brief search, officers located and seized a shotgun in the woods in the vicinity of the area where the suspect was observed coming out of the woods. Witnesses identified the suspect as being the shooter.

Rodney Adam Forbes, age 28, of 59 Wintergreen Patch Road, Burnsville, N.C., was arrested and charged with:

  • Assault with a Deadly Weapon with Intent to Kill (Felony) and
  • Possession of Firearm by Felon (Felony).

Mr. Forbes was held in jail under a $120,500.00 secured bond and is scheduled to appear in Mitchell County District Court on September 5, 2017.

The victim who was shot was transported by paramedics to Blue Ridge Regional Hospital where he was treated and later released.

Forbes was released from the North Carolina Department of Public Safety Adult Correction Division as recently as last year, in October 2016.

The investigation is ongoing and more charges are expected.

All suspects are presumed innocent until proven guilty in a court of law.
