Couple Arrested After Video of a Domestic Disturbance was Posted on Facebook

HAWK, N.C. — Two people were arrested after a very graphic video of a domestic disturbance was uploaded and shared on the Internet.

Telecommunicators with Mitchell County Communications began receiving calls in the late evening on Sunday, February 19, 2017 from citizens reporting that they had watched a video online of a domestic disturbance between a male and female and that the video was being shown live on the web at the social media site Facebook. The video had been recorded by one of the parties involved in the disturbance, who then uploaded the video to their own Facebook page and shared it where any of their online friends could watch it.

Communications dispatched deputies with the Mitchell County Sheriff’s Office to respond and conduct a welfare check on the couple in the online video, but was not sure where deputies should respond to because the location of the disturbance had not yet been determined.  After deputies obtained additional information about the the couple involved in the disturbance, they advised they were very familiar with the couple and the location of their residence, as they had responded to their residence located in the 3800 block of Cane Creek Road in the past to investigate previous reports of domestic disturbance complaints.

Once on scene, deputies made contact with a male at the residence, who was believed to be the male party involved in the domestic disturbance in the online video. After a brief interview, officers determined that, despite the video being shared online earlier that evening, the domestic disturbance actually occurred the night before and that both parties involved in the disturbance had already separated. Officers cleared the scene then returned to service.

The next day various citizens sent Mitchell County Sheriff Donald Street a copy of the video of the domestic disturbance. After reviewing the video, the Sheriff’s Office decided that it was best to charge both individuals.

Heather Danielle Pendley, age 32, and Roy Alton Jones, age 36, both of 3837 Cane Creek Road, Bakersville, N.C., were identified as the two suspects involved in the domestic disturbance in the online video and were charged with a single count of Misdemeanor Simple Assault. Pendley was arrested on February 20, 2017 and held in jail under a $1,500 secure bond; Jones was later arrested on February 23, 2017 and held in jail under a $5,000 secure bond. Both are schedule to make their first appearance in Mitchell County District Court on March 29, 2017.

Lt. Detective C. Hobson, Lt. J. English, and Deputy P. Caudill of the Mitchell County Sheriff’s Office were the charging officers.

All suspects are presumed innocent until proven guilty in a court of law.
